The following general terms and conditions of sale apply to any order placed on the "Europe" section of the website www.blueice.com ("BlueIce.com"). They govern the purchase of products (the "Products") available on the BlueIce.com website by Blue Ice Europe SASU ("Blue Ice").
BlueIce.com is operated by:

Please read these terms and conditions carefully.
1 - Application of these General Terms and Conditions of Sale ("GTCS")
These GTCS apply solely to purchases of Products made through the BlueIce.com website. We reserve the right to amend these GTCS at any time. The effective date of these GTCS is indicated above. The applicable GTCS are those in effect at the time of order placement.
2 - Eligible Buyers
To be eligible to purchase the Products, you must:
- Provide your name, address, phone number, email address, payment details, and any other required information;
- Be at least 18 years of age.
3 - How to Place an Order
After selecting one of our Products on the commercial section of BlueIce.com, choose the size, color, and quantity you wish to order. The selected Product(s) can then be transferred to your cart by clicking on the "Add to Cart" button. You can then either add more Products to your cart or finalize your order by clicking on the "Cart" button located in the top right corner of the page.
You will then need to enter your delivery address and contact details and choose a shipping method. If your billing address is different from your delivery address, you can enter your billing address by unchecking the box "Use as Billing Address." At this stage, you can still remove Products from your cart or modify the Products in your cart.
The next page allows you to enter your payment information and review the total order amount. On this same page, you can also modify your delivery and/or billing address, change the selected shipping method, remove Products from your cart, or modify the Products in your cart.
Your order will be placed once you click on the "Confirm Order" button.
After placing your order, you will receive an email from us acknowledging receipt of your order. Please note that this acknowledgment does not mean that your order is accepted. Your order constitutes an offer to purchase the Products you have selected based on these general terms and conditions. All orders are subject to our acceptance, which we will confirm by sending you an email confirming that the Products have been shipped (the "Order Shipping Confirmation").
The contract between you and us is formed only when we send you the Order Shipping Confirmation (the "Contract").
The Contract applies solely to those Products whose shipment is confirmed by us in the Order Shipping Confirmation. As long as the shipment of any other Product that may be part of your order is not confirmed in a separate Order Shipping Confirmation, we shall not be obligated to supply that other Product.
Your order will be fulfilled by the delivery date specified in the Order Shipping Confirmation or, if no date is provided, within 30 days from the date of the Order Shipping Confirmation, except under exceptional circumstances.
4 - Pricing, Shipping Fees, and Order Processing
The prices of the products are those displayed on the BlueIce.com website, except in cases of obvious error. The currency in which the prices are shown is determined as follows:
- Euro: Austria, Germany, Belgium, Denmark, Spain, France, Italy, Netherlands, Czech Republic
- Pound Sterling: United Kingdom
- Swiss Franc: Switzerland
The prices of the products displayed on the website include Value Added Tax (VAT). All prices are exclusive of shipping fees. The amount of shipping fees varies depending on the country to which your order is delivered. For more details on shipping fees by country, please refer to our page: Shipping policy.
The price charged for a product will be the price in effect at the time the order is placed, as shown on the product page with any applicable discounts in the cart and will be indicated in the order confirmation email.
We reserve the right to modify product prices at any time and without prior notice. Price increases will only apply to orders placed after the changes have been made.
It is always possible that, despite our best efforts, the price of some products displayed on the BlueIce.com website may be incorrect. We are under no obligation to sell you the products at the incorrect price (lower than the actual price), even after we have sent you an Order Shipping Confirmation, if the pricing error is clear and obvious and could have reasonably been recognized by you as an error.
5 - Product Availability
We do not guarantee the availability of products in our online store. Except for orders already accepted, we reserve the right, without incurring any liability and without prior notice, to change, discontinue, or cease the sale of any product.
6 - Payments, Payment Security, and Transfer of Ownership
6.1 - Payment
Payment can be made using the payment methods indicated during the ordering process on the BlueIce.com website.
All payments will be subject to security checks. Therefore, our services may contact you to confirm your order details and order data, such as proof of your address or that of the person designated for the delivery address, or a piece of identification.
6.2 - Security
All payment information is encrypted and transmitted over the internet in a protected format. Payment is processed through the secure payment service of our partner provider, which complies with the required security standards.
6.3 - Ownership of Products
Ownership of the Products is transferred to you upon receipt of full payment of all sums due for the Products, including delivery fees, at the time of delivery of the said Products to the delivery address provided by you during the order process.
6.4 - Tax Invoices / VAT Receipts
Sales on the BlueIce.com website are intended for non-business consumers, and VAT at the applicable rate in the delivery country will be charged. You can request a copy of your invoice by writing to directsales@blueice.com, but it is currently not possible to issue an invoice containing a customer VAT number.
Payments in Pound Sterling and Swiss Francs will be invoiced in Euros at the exchange rate of the day provided by the payment service provider.
7 - Right of Withdrawal
7.1 - Right of Withdrawal
You have the right to withdraw from the sales contract concluded upon your purchase of a Product on our website without providing any reason. The withdrawal period is 14 days from the day you, or a third party other than the carrier and designated by you, physically takes possession of the Product.
7.2 - Exercising the Right of Withdrawal
To exercise the right of withdrawal, please refer to our return policy at the following address: Refund policy. You can also notify us of your decision to withdraw from the contract through a clear statement (for example, a letter sent by post or email). This statement must include your name, your geographic address, your phone number, and your email address.
You may use the withdrawal form template included in these terms and conditions of sale, but it is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication regarding the exercise of the right of withdrawal before the withdrawal period expires.
7.3 - Effects of Withdrawal
Once Blue Ice receives your withdrawal request, Blue Ice will refund all amounts paid, subject to the clarifications below, including delivery costs (excluding any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery method offered by us), without undue delay and, in any case, no later than 14 days from the day we are informed of your decision to withdraw.
We will proceed with the refund using the same payment method you used for the initial transaction; in any case, this refund will not incur any fees for you.
If you decide to withdraw after the Product has been shipped, please refer to our return policy at Refund policy.
You must return the Product to us in any case, no later than 14 days after you have communicated your decision to withdraw from the contract. This deadline is deemed met if you send back the goods before the 14-day period expires.
Please note that Blue Ice reserves the right to withhold the refund until we have received the Product.
You are only responsible for any diminished value of the Product resulting from handling other than what is necessary to establish the nature, characteristics, and proper functioning of the Product.
7.4 - Exclusion of Withdrawal
In accordance with the provisions of Article L.221-28 of the French Consumer Code, please note that the right of withdrawal does not apply, particularly:
- To purchases of Products made according to your specifications or clearly personalized;
- To purchases of Products unsealed after delivery and that cannot be returned for hygiene or health protection reasons.
8 - Warranty
8.1 - Legal Guarantee of Conformity
In accordance with applicable legal provisions, you are entitled to a legal guarantee of conformity for a duration of two (2) years from the delivery of the Product. During this period, you only need to demonstrate the existence of the defect of conformity, without having to prove the date it appeared.
The legal guarantee of conformity allows you to obtain, free of charge and within thirty (30) days of your request, the repair or replacement of the Product, at no cost and without major inconvenience to you.
If a repair is carried out under this legal guarantee of conformity, the original warranty period is extended by six (6) months.
If you request a repair and Blue Ice proceeds with a replacement, the legal guarantee of conformity is renewed for a duration of two (2) years from the date of replacement of the Product.
A reduction in the purchase price while keeping the Product, or a full refund upon the return of the Product, may be obtained in the following cases:
- Blue Ice refuses the repair or replacement;
- The thirty (30) day period following your request for repair or replacement is exceeded;
- The repair or replacement causes a significant inconvenience to you (e.g., when you permanently bear the costs of returning or removing the non-conforming Product, or the costs of installation for the repaired or replacement Product);
- The defect persists after an unsuccessful attempt by Blue Ice to remedy the non-conformity.
In cases of serious non-conformities, you can directly request a reduction in the Product's price or the termination of the contract without initially requesting repair or replacement. However, termination of the contract is not applicable if the non-conformity is minor.
Any immobilization of the Product for repair or replacement suspends the warranty period until you recover the repaired Product.
These rights are derived from Articles L. 217-1 to L. 217-32 of the French Consumer Code.
The seller acting in bad faith to hinder the application of the warranty may face a fine of up to 300,000 euros or 10% of their average annual revenue (Article L. 241-5 of the French Consumer Code).
8.2 - Warranty Against Hidden Defects
You are also entitled to a warranty against hidden defects, as stipulated by Articles 1641 to 1649 of the French Civil Code, for two (2) years from the discovery of the defect. This warranty allows for either a price reduction if the Product is retained, or a full refund upon return of the Product.
8.3 - Exclusions from Warranties
The legal guarantees of conformity and hidden defects do not cover the following damages:
- Normal wear and tear of the Product;
- Damages caused by transport or improper storage due to your actions;
- Use not in accordance with the Product's intended purpose or inadequate maintenance;
- Non-compliance with the usage and maintenance instructions in the Product manual;
- Modifications or repairs performed by a third party not authorized by Blue Ice or an approved reseller;
- Shocks, twists, compressions, falls, abnormal impacts, or any other damage resulting from excessive or improper use.
8.4 - Implementation of Warranties

9 - Personal Data
The purchase of Products on the BlueIce.com online store is subject to your acceptance of the Privacy Policy and the processing of personal data as described here: Privacy policy.
We will take all reasonable measures to protect your order and payment data securely; however, (in the absence of gross negligence on our part) we shall not be held liable for any loss you may suffer if a third party gains unauthorized access to any data you provided while accessing or placing an order via the website.
10 - Liability
It is your responsibility to take all reasonable steps and precautions to ensure that the Product(s) you order meet your needs, unless you informed us of such purposes at the time of concluding the Contract and we accepted them. You must follow all advice we provide concerning the Product(s) (including instructions, user guides, and/or manuals provided with the Product(s)). We accept no liability for damage to the Product(s) we supplied that is caused by your failure to follow our advice. While we strive to verify the accuracy of the information we publish on BlueIce.com, we do not guarantee that the BlueIce.com website will meet all your requirements.
10.1 - Force Majeure
We disclaim any liability for failure to perform, or delays in the performance of, any of our obligations under these terms and conditions that result from events reasonably beyond our control ("Force Majeure," as defined by French court case law).
The performance of our obligations under these terms and conditions shall be deemed suspended for the duration of the Force Majeure event, and we shall be granted an extension of the time to perform our obligations for a period equal to the duration of the Force Majeure event. We will endeavor, within reasonable limits, to end the Force Majeure event or find a solution that allows us to fulfill our obligations under the Contract despite the Force Majeure event.

12 - Governing Law and Dispute Resolution
These general terms and conditions of sale are governed and interpreted in accordance with French law.
12.1 - Consumer Dispute Mediation
In the event of a dispute, and in accordance with Articles L612-1 and following of the French Consumer Code, you may freely use the mediation service provided by Blue Ice, provided that you have first attempted to resolve the dispute with Blue Ice via a written claim.

You may contact the mediator within 12 months of the date of the first written claim made to Blue Ice.
Alternatively, you can also submit your claim through the European Commission's online dispute resolution platform: www.ec.europa.eu/consumers/odr.
12.2 - Jurisdiction
If no amicable agreement is reached after an attempt at mediation, any dispute will be submitted to the competent French courts.
